LITTLE ROCK — A driver who caused a wreck that killed a Faulkner County man Monday night has been charged with operating a vehicle while intoxicated and negligent homicide, prosecutors said Thursday.
Guadalupe Lopez, 32, was behind the wheel of a Ford Taurus that forced a Ford van driven by 37-year-old Gary Harp off of Interstate 40 shortly after 8 p.m. near Mayflower, Arkansas State Police said. Harp reportedly over-corrected, sending his vehicle toppling off the roadway and into a ditch. He was killed after being partially ejected.
Police, who had received reports of the Taurus driving erratically, tracked it to Lopez’ residence in Conway within hours of the wreck. There, police spoke with Lopez and determined he had a blood alcohol level above the legal limit, said Twentieth Judicial District Prosecuting Attorney Marcus Vaden.
Lopez made no attempt to stop, Vaden said, and a search of his car also yielded a small amount of methamphetamine.
“(Harp) was just driving down the road, minding his own business, apparently a law-abiding citizen doing a lawful activity and he was killed,” Vaden said. “He virtually got the death penalty from a situation that was not an accident. It was a needless situation to occur.”
Investigators say Lopez, who was also driving without a license and without insurance, is an illegal immigrant. Immigrations and Customs Enforcement has reportedly begun a deportation process on him.
“This is a tragic case and on behalf of my office I want to express my deepest sympathies to the family of the victim,” Vaden said in a statement. “While I am pleased the deportation process is proceeding, it is important to note that the State of Arkansas has every intention of prosecuting and punishing Mr. Lopez before he leaves this country.”
Lopez is being held in the Faulkner County Detention Center in lieu of a ,000 bond.

The victim over-corrected and then was partially ejected. Perhaps he’d still be alive if was operating a vehicle he knew how to handle or had been wearing his seatbelt. Lopez must have been pretty hammered if he was still legally drunk hours later, which would probably explain why he didn’t stop. He probably didn’t even notice the accident to the other vehicle occuring.
This story is more an indictment against drunk driving and safe vehicle operation than against illegal immigration. The fact that the drunk man was an illegal immigrant seems irrelevant to this story. Maybe if conservatives weren’t so jaded against him, he wouldn’t have felt the need to drink so much.
wow. another backbone of our workforce and an economy contributor sits in jail. whats with those authorities out there? don’t they realize people like mr lopez are only here for a better life ,just want to contribute, seems such a waste having him sit idle while we need him and all those people out there doing the jobs we wont do. we need to stop this racial profiling so those people can get us out of our economy woes
He should be executed, and his whole extended family deported.
He deprived some family of a member, so HIS whole family should be punished.
That’s the only type of justice these dirty vermin understand.
Activists get outraged when something happens at the border and demand action and here they are oh well…Activists have stated illegals do not use drugs and what was a small amount of methamphetamine doing in his car ? Will activists claim the police planted it ? Illegals cause fatal accidents take off without regard to the damage they left behind and strangely activists support the illegal in this case
Who supports drunk driving? Nobody. He should be deported.
This could be said for any person drunk driving in this country. There about 100,000 fatalities caused by alcohol impaired driving per year, most are NOT illegal aliens but US citizens.

and you can have a ball searching all the morbid news stories of all the LEGAL drunk drivers of this country. In my state, there has been only 2 instances of DUI with an accident, one relating in a death, by an illegal immigrant in the last 2 yrs. There were over 1, 238 of ticketed DUI’s in my county alone in 2009 with a population estimate of 92,000 + and only 6 were of Hispanic origin and only 2 illegal and none were in an accident which involved another vehicle.
